Orlando Vadel, NJ ASK coordinator, responded to an e-mail with:
"As per New Jersey Administrative Code, public students are enrolled in the grades, in which we assess (i.e., grades 3 through 8), are expected to participate in our statewide assessment program.

Having said that, as the parent, you will determine what you will do with regards to testing for your child.

If your child is absent for testing, he will be identified as such on the reports the schools receive."

He later indicated that if my child shows up at school on test days, the school must test him. (Doesn't mean he has to answer...)
